Terms of Use.

These Terms of Use are a contract between you and Prolean Wellness Management LLC (“Goprolean”, “we”, “us”), 9360 E Raintree Dr, Scottsdale, AZ 85260. They govern your use of goprolean.com and the patient portal at member.goprolean.com (together, the “Platform”).
By using the Platform or buying anything through it, you accept these Terms. If you do not accept them, do not use the Platform.
1. What Goprolean is, and what it is not
Goprolean is not a medical practice and does not practise medicine. We provide the technology and administrative platform that connects you with licensed clinicians and licensed pharmacies.
Medical care is provided by independent, licensed clinicians and professional entities who exercise their own independent professional judgement. They are not our employees or agents, and we do not control their clinical decisions. Prescriptions are dispensed by independent licensed pharmacies.
Using the Platform does not create a doctor–patient relationship with Goprolean. That relationship exists between you and the clinician who treats you.
Nothing on the Platform is medical advice. Content on our website, including articles and treatment information, is general information, not a recommendation for you.
2. This is not for emergencies
The Platform is not for medical emergencies. If you are having a medical emergency, call 911 or go to your nearest emergency room. Do not use the Platform to seek urgent or emergency care. We do not monitor messages in real time.
If you are in crisis or thinking about harming yourself, call or text 988 to reach the Suicide and Crisis Lifeline.
3. Who can use the Platform
You may use the Platform if you are 18 or older, live in the United States, and are located in a state where our clinicians are licensed and able to treat you. Availability varies by state, and the rules for what a clinician may do without a live consultation differ from state to state.
You must give accurate, complete and current information about your health, your medications and your identity. Clinical decisions are made from what you tell us. Giving false or incomplete information can lead to unsafe treatment, and we may suspend or close your account for it.
You may not use the Platform on someone else’s behalf, or let anyone else use your account.
4. Treatment is not guaranteed
Submitting an intake, paying a fee, or creating an account does not entitle you to a prescription.
A clinician may decide that treatment is not appropriate for you, may recommend something different from what you requested, may ask for more information or testing, or may decline to treat you. That is a clinical judgement and it is theirs to make.
If a clinician declines to prescribe, you have still received the medical evaluation you paid for. See section 8.
5. About the medications
Medications available through the Platform include FDA-approved brand-name and generic products, and medications prepared by licensed 503A compounding pharmacies. Which one is right for you is a clinical decision your clinician will make with you.
About compounding
Compounding is the preparation of a medication by a licensed pharmacist for an individual patient, under a prescription written for that patient. It is a long-established part of pharmacy practice, used when a commercially manufactured product is not suitable — for example, where a patient reacts to an inactive ingredient in the approved product, needs a different form or route, or requires a strength that is not commercially manufactured.
503A compounding pharmacies are licensed and inspected by their state boards of pharmacy and are required to compound in accordance with United States Pharmacopeia standards.
Compounded medications are not FDA-approved. They do not go through the FDA’s premarket approval process, and the FDA does not review them for safety, effectiveness or quality before they are dispensed. This is true of every compounded medication and is not a comment on any particular pharmacy.
Federal law also limits when a medication may be compounded, including where an FDA-approved version is commercially available. Your clinician determines and documents whether a compounded medication is clinically appropriate for you.
All medications carry risks and side effects. Read the information provided with your medication, follow your clinician’s directions, and tell your clinician about any side effects or changes in your health.
6. Your account
Keep your password confidential and tell us promptly at support@goprolean.com if you think someone else has accessed your account. You are responsible for activity under your account.
7. Subscriptions, billing and cancellation
Many of our plans are subscriptions that renew automatically until you cancel.
Before you subscribe we will show you the price, the billing frequency, what is included, and how to cancel. You will be asked to agree to those terms specifically before we take your payment details.
Renewal. Your subscription renews automatically at the end of each billing period at the price shown when you subscribed, and your payment method is charged on the renewal date. Payments are processed by Stripe.
Price changes. If we change the price of your subscription, we will tell you in advance and you will have the chance to cancel before the new price takes effect.
Cancelling. You can cancel at any time in your account at member.goprolean.com, or by emailing support@goprolean.com. Cancellation takes effect at the end of your current billing period. You will not be charged again after you cancel. We will not require you to call anyone, wait on hold, or explain yourself in order to cancel.
Cancelling a subscription is not the same as stopping treatment. Talk to your clinician before stopping a prescribed medication.
Medication already in progress. If you cancel after a prescription has been sent to the pharmacy for the current period, that order may still ship and is not refundable. See section 8.
8. Fees and refunds
Prices are in US dollars and exclude tax where tax applies. You are responsible for the fees you incur.
Medical evaluation fees are non-refundable once a clinician has reviewed your intake, whether or not they prescribe. You are paying for the clinician’s time and judgement, not for a particular outcome.
Prescription medication cannot be returned or refunded once it has been dispensed. This is a requirement of pharmacy law, not a business policy — a dispensed prescription cannot lawfully be returned to stock or re-dispensed.
If your order does not arrive, arrives damaged, or is wrong, contact support@goprolean.com and we will put it right.
9. Shipping
We ship within the United States only. Delivery times are estimates. Risk of loss passes to you on delivery. Some medications require someone to be present, or have temperature requirements; follow the storage instructions provided with your medication.
10. Messages from us
By giving us your phone number you agree that we and our clinicians and pharmacies may contact you by call or text about your care, your orders and your account. Message and data rates may apply.
Marketing texts are separate. We will only send those if you opt in specifically, and you can stop them at any time by replying STOP. Stopping marketing texts does not stop messages about your treatment or orders.
You can unsubscribe from marketing email using the link in any message.
11. Acceptable use
Do not use the Platform to break the law; to obtain medication for anyone other than yourself; to resell, divert or misuse medication; to misrepresent your identity or health; to interfere with or attack the Platform; to scrape or copy it; or to reverse engineer it.
12. Our content
The Platform, its design, text, graphics, logos and software belong to us or our licensors and are protected by intellectual property law. You may use the Platform for your own personal, non-commercial purposes. You may not copy, republish or create derivative works from our content without our permission.
You keep ownership of the information and images you upload. You give us permission to use them to provide the services — including sharing them with your clinician and pharmacy — and to keep them as our records and legal obligations require.
13. Links to other sites
The Platform may link to sites we do not control. We are not responsible for them.
14. Disclaimers
Except as stated in these Terms, the Platform is provided “as is” and “as available”, and we disclaim all warranties to the fullest extent the law allows, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.
We do not warrant that the Platform will be uninterrupted or error-free.
Nothing in these Terms limits or excludes the professional responsibility of the clinicians and pharmacies who treat you. Their obligations to you are governed by the law of their profession and their own agreements with you, and are not affected by this section.
15. Limitation of liability
To the fullest extent the law allows, Goprolean will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or lost data, arising out of your use of the Platform.
Our total liability for any claim relating to the Platform will not exceed the greater of the amount you paid us in the twelve months before the claim, or one hundred US dollars.
This section does not apply to liability that cannot be limited by law, or to the professional liability of your clinician or pharmacy.
Some states do not allow certain limitations, so parts of this section may not apply to you.
16. Indemnity
You agree to indemnify Goprolean against claims, losses and reasonable legal costs arising from your breach of these Terms, your misuse of the Platform, or information you gave us that was false or incomplete.
17. Disputes
Talk to us first. If you have a problem, email support@goprolean.com with a description of it and what you would like us to do. Most issues are resolved this way, and we ask that you give us 30 days to try before starting formal proceedings.
Any dispute that cannot be resolved informally will be brought in the state or federal courts located in Maricopa County, Arizona, and you and we consent to the jurisdiction of those courts.
This section does not apply to claims against a clinician, professional entity or pharmacy relating to your medical care. Those are governed by the law of the state where you were treated and by any agreement you have with that provider.
18. Governing law
These Terms are governed by the laws of the State of Arizona, without regard to its conflict of laws rules.
19. Changes to these Terms
We may change these Terms. We will post the updated version here and change the date at the top. If a change is material, we will tell you before it takes effect. Continuing to use the Platform after that means you accept the change. If you do not accept it, stop using the Platform and cancel any subscription.
20. General
If any part of these Terms is unenforceable, the rest stays in force. Our not enforcing a provision does not waive it. You may not transfer these Terms; we may transfer them to a successor in connection with a merger, acquisition or sale of assets. These Terms, together with our Privacy Policy and any telehealth consent you sign, are the entire agreement between us about the Platform.
